Defeating the company that was awarded the contract to supply e-buses is Tata Motors.
The contract Brihanmumbai Electric Supply & Transport awarded to Evey to provide 2,100 electric buses was contested by Tata Motors.
When the Bombay High Court on Tuesday revoked a contract given in May to a subsidiary of Olectra Greentech for the supply of electric buses to the city's transportation authority, Tata Motors won a case against Evey Trans.
The large automaker had contested the BEST (Brihanmumbai Electric Supply & Transport) contract that Evey received to provide 2,100 electric buses. A setback for Evey is the cancellation of the tender, which was valued Rs 3,675 crore and was one of the largest orders in e-mobility. It obtained the contract by submitting the lowest bid.
Tata Motors objected to the contract on the grounds that BEST had permitted Evey Trans to modify its offer two hours prior to a technical examination. Tata Motors was represented by Karanjawala & Co. and other law firms.According to a statement from Karanjawala, this broke the terms of the contract, which forbade alterations after the technical bids were opened.
It was expressly forbidden in the tender for bidders to improperly influence BEST by getting in touch with the agency about any issue during the technical bid evaluation. After it was opened on May 4, BEST permitted Evey Trans to amend their offer.
In order to protect the integrity of the tendering process, Tata Motors has pleaded with the court to adopt a strict stance on the BEST favour given to Evey Trans.
The court upheld Tata Motors' disqualification. However, if BEST floats a fresh tender, Tata Motors will be able to bid afresh.The supply order was based on the Gross Cost Contract (GCC) /Operational expense model for a period of 12 years, according to media reports. Evey was to procure the electric buses either directly by itself or through its special purpose vehicle from Olectra Greentech. The buses were to be delivered over a period of 12 months. Olectra was to also undertake maintenance of the buses during the contract period.
